This Copyright Policy explains how Noveltree handles copyright, trademark, publicity, privacy, plagiarism, and other rights complaints about content on the service.

  • Creators are responsible for owning or controlling the rights needed to submit, publish, promote, distribute, and monetize content through Noveltree.
  • Send copyright, trademark, publicity, privacy, plagiarism, and similar rights complaints to copyright@noveltree.ca.
  • Noveltree may remove, restrict, age-gate, reduce visibility for, or disable monetization for reported content while a complaint is reviewed.
  • Noveltree may pause related royalty review, Creator Consumable Credit Elections, or payouts where the policy permits it.

1. Creator responsibility

Creators are responsible for ensuring that they own or control all rights needed to submit, publish, promote, distribute, and monetize their content through Noveltree. Creators must not upload content that infringes, misappropriates, plagiarizes, or violates the rights of another person or entity.

2. Copyright agent and complaint requirements

If you believe content on Noveltree violates your copyright or other rights, contact:

U.S. Copyright Office DMCA designated agent directory record: Fictiondex Inc., registration number DMCA-1073245. The registration is active. Registered alternate names are Fictiondex, Noveltree, noveltree.ca, and fictiondex.com.

For copyright complaints, including notices intended to qualify under the U.S. Digital Millennium Copyright Act where applicable, include:

  • your physical or electronic signature, or the signature of a person authorized to act for the rights holder;
  • identification of the copyrighted work you claim has been infringed;
  • the URL or enough information for us to locate the allegedly infringing content on Noveltree;
  • your name, mailing address, telephone number, and email address;
  • a statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, the copyright owner's agent, or the law; and
  • a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act for the copyright owner.

For trademark, publicity, privacy, plagiarism, or other rights complaints, include:

  • your name and contact information;
  • the work, content, brand, likeness, or right you believe is being violated;
  • the URL or enough information for us to locate the content on Noveltree;
  • a description of why you believe the content violates your rights;
  • a statement that the information in your complaint is accurate; and
  • a statement that you are the rights holder or are authorized to act for the rights holder.

We may ask for additional information before taking action. Knowingly submitting false or misleading complaints may result in account action or legal responsibility.

3. Review and temporary action

When Fictiondex Inc. dba Noveltree receives a rights complaint, we may quickly remove or restrict the reported content, disable access to it, disable monetization for it, reduce its visibility, or age-gate it while we review. We may also pause Copyright Royalties review, Creator Consumable Credit Elections, or payouts related to disputed content where reasonably necessary for legal, fraud, refund, chargeback, tax, payment-provider, or compliance reasons.

We may provide the complaint or complaint details to the creator, service providers, advisors, regulators, courts, or others where legally permitted or required, or where reasonably necessary to evaluate or resolve the dispute.

4. Creator responses, counter-notices, and restoration

If your content is removed or restricted because of a rights complaint, we may allow you to provide a response, counter-notice, authorization evidence, ownership documentation, licence information, or other explanation. We are not required to restore content, monetization, Creator Consumable Credit eligibility, or payouts unless required by law or determined appropriate by Fictiondex Inc. dba Noveltree.

If you believe your content was removed or disabled because of mistake or misidentification, you may send a counter-notice to copyright@noveltree.ca. A counter-notice should include:

  • your physical or electronic signature;
  • identification of the content that was removed or disabled and where it appeared before removal;
  • a statement, made under penalty of perjury, that you have a good-faith belief the content was removed or disabled because of mistake or misidentification;
  • your name, mailing address, telephone number, and email address; and
  • if U.S. law applies, a statement that you consent to the jurisdiction of the federal district court for your judicial district, or if you are outside the United States, to the jurisdiction of a federal district court in which Fictiondex Inc. dba Noveltree may be found, and that you will accept service of process from the person who submitted the original notice or that person's agent.

For a counter-notice that satisfies 17 U.S.C. § 512(g), Noveltree will promptly provide a copy to the person who submitted the original notice and inform that person that Noveltree will replace the removed material or restore access to it. Noveltree will replace the material or restore access no sooner than 10 and no later than 14 business days after receiving the counter-notice, unless our Copyright Agent first receives notice that the original complainant has filed an action seeking a court order to restrain the allegedly infringing activity.

Noveltree may continue to restrict material on a separate legal, contractual, safety, fraud, security, or non-DMCA rights basis where permitted. Any such separate restriction does not change how Noveltree handles a qualifying counter-notice under the DMCA.

5. Repeat infringement and abusive complaints

Fictiondex Inc. dba Noveltree may suspend or terminate accounts, creator participation, monetization, payout eligibility, or access for repeat infringers, creators who repeatedly submit unauthorized content, or users who repeatedly submit false or abusive complaints.

We may consider the number, seriousness, timing, and validity of complaints; counter-notices or creator responses; evidence of authorization; patterns of evasion; and other relevant circumstances when applying this repeat-infringer policy.

6. Other rights and legal process

This policy does not limit any rights or remedies available under applicable law. We may comply with court orders, regulator requests, law-enforcement requests, app-store requirements, payment-provider requirements, and other legal or compliance obligations.
